The <a href=\"https:\/\/www.gazzettaufficiale.it\/eli\/id\/2004\/07\/15\/004G0201\/sg\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.gazzettaufficiale.it\/eli\/id\/2004\/07\/15\/004G0201\/sg&amp;source=gmail&amp;ust=1634047082028000&amp;usg=AFQjCNGLuqqJYl5ZdNensnDxHwS_5kkdww\">Italian reference text on food supplements<\/a> even mentions such indications as compulsory (within the limits of the normative framework), a provision that is not present in European nor in French texts. On this foundation lies a series of claims on physiological effects that may be attributed to botanicals, probiotics, prebiotics and other substances; as such statements do not meet the definition of health claims, they do not need to be preventively approved at the European level.<\/p>\n<p>In particular, the use of a claim on the physiological effects of probiotics has been authorized in Italy since the setting of the first national guidelines on the matter, which also sets for the\u00a0<strong>term probiotic<\/strong>\u00a0to be allowed for use on food supplements meeting certain <a href=\"https:\/\/www.salute.gov.it\/imgs\/C_17_pubblicazioni_1016_ulterioriallegati_ulterioreallegato_0_alleg.pdf\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.salute.gov.it\/imgs\/C_17_pubblicazioni_1016_ulterioriallegati_ulterioreallegato_0_alleg.pdf&amp;source=gmail&amp;ust=1634047082028000&amp;usg=AFQjCNE4PvqEXmGPCXlJTyu7Tqv5EHCrmg\">requirements<\/a>.\u00a0In France, for the time being the use of the term is not allowed; however, a statement indicating it as a non-specific health claim was recently withdrawn from the French authority\u2019s website\u00a0.<\/p>\n<p>Speaking of\u00a0<strong>French authorities<\/strong>, one aspect that characterizes them is their willingness to\u00a0<strong>cooperate with the industry<\/strong>\u00a0in order to find mutual understandings on crucial issues, as has happened with the creation of the lists on permitted essential oils and their <a href=\"https:\/\/www.synadiet.org\/les-complements-alimentaires\/quest-ce-que-cest\/listes-synadiet-huiles-essentielles-doses-conseillees\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.synadiet.org\/les-complements-alimentaires\/quest-ce-que-cest\/listes-synadiet-huiles-essentielles-doses-conseillees&amp;source=gmail&amp;ust=1634047082028000&amp;usg=AFQjCNFu5Gwo26YPUcH0K0tpwFrMMMUjyw\">conditions of use<\/a>.<\/p>\n<p><strong>Last but not least, what can be said about the approach of the two countries on permitted food supplement ingredients?<\/strong><\/p>\n<p>Both France and Italy identify\u00a0<strong>three macro-categories\u00a0<\/strong>of active ingredients: vitamins and minerals, plants and plant-based preparations (botanicals), and \u201cother substances\u201d with a physiological or nutritional effect.<\/p>\n<p>The list of\u00a0<strong>vitamins and minerals<\/strong>\u00a0that can be added to food supplements is common across the European Union, but conditions of use as maximum daily doses or additional labelling requirements differ between countries, including <a href=\"https:\/\/www.salute.gov.it\/imgs\/C_17_pagineAree_1268_5_file.pdf\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.salute.gov.it\/imgs\/C_17_pagineAree_1268_5_file.pdf&amp;source=gmail&amp;ust=1634047082028000&amp;usg=AFQjCNEHivqWlAilyAPaLcxwO4EaIdyLsg\">Italy<\/a> and <a href=\"https:\/\/www.economie.gouv.fr\/files\/files\/directions_services\/dgccrf\/securite\/produits_alimentaires\/Complement_alimentaire\/CA_Internet_RS_Nutriments.pdf\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.economie.gouv.fr\/files\/files\/directions_services\/dgccrf\/securite\/produits_alimentaires\/Complement_alimentaire\/CA_Internet_RS_Nutriments.pdf&amp;source=gmail&amp;ust=1634047082028000&amp;usg=AFQjCNGvuCDkNPme256yOzAH776sgaKUIw\">France<\/a>.<\/p>\n<p>Regarding\u00a0<strong>botanicals<\/strong>, a common ground between the two countries had been set by their collaboration in elaborating the <a href=\"https:\/\/www.economie.gouv.fr\/dgccrf\/projet-belfrit-cooperation-reussie-au-sein-lunion-europeenne\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.economie.gouv.fr\/dgccrf\/projet-belfrit-cooperation-reussie-au-sein-lunion-europeenne&amp;source=gmail&amp;ust=1634047082028000&amp;usg=AFQjCNHB1B2bdBxYp3X1hqFnPCmO3W39Qg\">Belfrit list<\/a>, which, however, ended up being used differently by each involved party. Italian authorities established a reference list of authorized plants, with a broad understanding of the term\u00a0as it also includes algae; a separate list is available on authorised fungi. French authorities, on the other hand, created <a href=\"https:\/\/www.economie.gouv.fr\/dgccrf\/complements-alimentaires-plantes\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.economie.gouv.fr\/dgccrf\/complements-alimentaires-plantes&amp;source=gmail&amp;ust=1634047082028000&amp;usg=AFQjCNG5MPnDfhTm2qzjtnZJIRl0wf7j7g\">separated lists for plants, algae, lichens, and plants whose essential oils can be used<\/a>. The list contents differ between the two nations.<\/p>\n<p>Finally, each of the two countries possesses a non-exhaustive national reference list on\u00a0<strong>other substances<\/strong>\u00a0with nutritional or physiological effects (<a href=\"https:\/\/www.economie.gouv.fr\/dgccrf\/complements-alimentaires-substances-a-but-nutritionnel-ou-physiologique\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.economie.gouv.fr\/dgccrf\/complements-alimentaires-substances-a-but-nutritionnel-ou-physiologique&amp;source=gmail&amp;ust=1634047082028000&amp;usg=AFQjCNHCfxJZ2b-kwwpRSsl0A_UpttcyTQ\">French<\/a> and <a href=\"https:\/\/www.salute.gov.it\/imgs\/C_17_pagineAree_1268_4_file.pdf\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.salute.gov.it\/imgs\/C_17_pagineAree_1268_4_file.pdf&amp;source=gmail&amp;ust=1634047082028000&amp;usg=AFQjCNEPBoxaApMWwn6mPb8pqn8mwznoNg\">Italian<\/a> lists).<\/p>\n<p><strong>In conclusion<\/strong>, Italy and France do have a somewhat similar approach to food supplements. Nevertheless, this does not imply that their regulations are perfectly overlapping, as a number of distinctive elements can be identified.
