{"id":8337,"date":"2022-04-22T17:15:26","date_gmt":"2022-04-22T16:15:26","guid":{"rendered":"https:\/\/science-nutrition.com\/?p=8337"},"modified":"2022-05-12T16:49:43","modified_gmt":"2022-05-12T15:49:43","slug":"an-asterisk-behind-the-claims-of-herbal-dietary-supplements-in-the-netherlands","status":"publish","type":"post","link":"https:\/\/science-nutrition.com\/en\/2022\/04\/22\/an-asterisk-behind-the-claims-of-herbal-dietary-supplements-in-the-netherlands\/","title":{"rendered":"An asterisk (*) behind the claims of herbal dietary supplements in the Netherlands"},"content":{"rendered":"<div class=\"l-subsection\"><div class=\"l-subsection-h\"><div class=\"l-subsection-hh g-html i-cf\">\n<div class=\"J0lOec\" style=\"text-align: center;\"><em><span class=\"VIiyi\" lang=\"en\"><span class=\"JLqJ4b ChMk0b\" data-language-for-alternatives=\"en\" data-language-to-translate-into=\"fr\" data-phrase-index=\"0\" data-number-of-phrases=\"3\"><span class=\"Q4iAWc\">You may see a claim followed by an <strong>asterisk<\/strong> on a herbal food supplement marketed in <strong>the Netherlands<\/strong>.<\/span><\/span> <span class=\"JLqJ4b ChMk0b\" data-language-for-alternatives=\"en\" data-language-to-translate-into=\"fr\" data-phrase-index=\"1\" data-number-of-phrases=\"3\"><span class=\"Q4iAWc\">These food supplements are composed of one or more plant(s) or plant extract(s) claiming effects on health.<\/span><\/span> <span class=\"JLqJ4b ChMk0b\" data-language-for-alternatives=\"en\" data-language-to-translate-into=\"fr\" data-phrase-index=\"2\" data-number-of-phrases=\"3\"><span class=\"Q4iAWc\">In accordance with European regulations on nutritional and health claims, only scientifically substantiated claims are permitted.<\/span><\/span><\/span><\/em><\/div>\n<p style=\"text-align: center;\"><em>\u00a0<\/em><\/p>\n<p><span class=\"VIiyi\" lang=\"en\"><span class=\"JLqJ4b ChMk0b\" data-language-for-alternatives=\"en\" data-language-to-translate-into=\"fr\" data-phrase-index=\"0\" data-number-of-phrases=\"3\"><span class=\"Q4iAWc\">The European Commission is in charge of deciding whether a health claim is approved.<\/span><\/span> <span class=\"JLqJ4b ChMk0b\" data-language-for-alternatives=\"en\" data-language-to-translate-into=\"fr\" data-phrase-index=\"1\" data-number-of-phrases=\"3\"><span class=\"Q4iAWc\"><a href=\"https:\/\/www.efsa.europa.eu\/en\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>EFSA<\/strong><\/a>, the European Food Safety Authority, validates the scientific substantiation of a health claim.<\/span><\/span> <span class=\"JLqJ4b ChMk0b\" data-language-for-alternatives=\"en\" data-language-to-translate-into=\"fr\" data-phrase-index=\"2\" data-number-of-phrases=\"3\"><span class=\"Q4iAWc\">The European authorities draw up a list of authorized claims that the Dutch administration has listed <\/span><\/span><\/span>in their <em><strong><a href=\"https:\/\/www.keuringsraad.nl\/gezondheidsproducten\/claimsdatabase\">claims database<\/a><\/strong><\/em>.<\/p>\n<ul>\n<li><strong>Health claims for herbal preparations <\/strong><\/li>\n<\/ul>\n<p>There is something special about claims on herbal supplements. The EFSA has not yet issued an opinion on this. The claims for herbs are therefore still &#8216;on hold&#8217;. It is not yet known how long it will take before EFSA makes any statements about this.<\/p>\n<ul>\n<li><strong>&#8216;On hold&#8217; disclaimer for herbal preparations <\/strong><\/li>\n<\/ul>\n<p>As long as there is no advice from EFSA and no decision from the European Commission, claims that are &#8216;on hold&#8217; may still be used. To make it clear that the underlying scientific evidence submitted has not yet been assessed, it has been agreed in the Netherlands that an &#8216;on-hold&#8217; disclaimer will be stated with these claims. This disclaimer is intended to point out to consumers that the authorization procedure of the health claim for the herb in question is still ongoing. This prevents misleading the consumer. The disclaimer is referenced with an asterisk. It stands behind the on-hold claim on the label and in all other communications.<\/p>\n<ul>\n<li><strong>Why &#8216;on hold&#8217;? <\/strong><\/li>\n<\/ul>\n<p>Internationally, there are many differences between herbal preparations. In one country these products are seen as medicine, in another as health product. That makes it difficult to assess the claims on this.<\/p>\n<ul>\n<li><strong>Examples of an &#8216;on hold&#8217; disclaimer for herbal preparations <\/strong><\/li>\n<\/ul>\n<p>At the Inspection Council we are often asked which disclaimers you can use. You may encounter the following terms:<\/p>\n<p>&#8211; Health claim pending approval by the European Commission,<\/p>\n<p>&#8211; Admission procedure for this health claim is still ongoing,<\/p>\n<p>&#8211; Health claim pending European authorization,<\/p>\n<p>&#8211; Health effect has not yet been officially established.<\/p>\n<ul>\n<li><strong>Useful! In that case, indicate under which ID number the claim is &#8216;on hold&#8217;, so that we can verify this. Also send the conditions of use. Also indicate how these relate to the amount of the substance in the product.<\/p>\n<p>If the product does not meet the conditions of use specified when the claim is submitted, the daily dose will have to be justified by means of scientific publications.
