According to the article 4(2) of Regulation (EU) 2015/2283, food business operators shall consult the Member State where they first intend to place the novel food, when they are unsure whether or not a food which they intend to place on the market within the Union falls within the scope of this Regulation. This procedure gives operators the possibility of asking a Member State about the Novel Food status of an ingredient to find out whether it is necessary to put together an authorization request file.
The Commission Implementing Regulation (EU) 2018/456 lays down the information requirements that need to be included in the consultation request. Once the recipient EU country reaches its conclusion on the novel food status of a food, the Commission publishes that information on the Commission’s website where the list of products using the consultation process is publicly available with the statement and the reasons for the statement.
